Below you will find the terms which govern your access to and use of our Website. Please review our terms of use before using or interacting with our Website.

 

1. About the Website and Eurail

 

1.1. The interrail.eu and eurail.com websites (collectively known as the “Website”) are operated by Eurail B.V. (“Eurail, we, us, our”), which is registered with the Netherlands Chamber of Commerce under number 3026952 and has a registered address of Leidseveer 10, 3511 HB, Utrecht, the Netherlands.

 

1.2. The Website exists for the purposes of providing general information on train travel in Europe and to sell Passes and Seat Reservations (“Website Purpose”).

 

1.3. In all cases, in the sale of a Pass or a Seat Reservation, we act as an intermediary on behalf of the participating railway carriers and ticket distributors.

 

2. Terms of use

 

2.1. Your access to and use of our Website is governed by these terms of use (“Terms”).

 

2.2. By accessing and using our Website, you agree to be bound by our Terms. If you do not agree to any of the terms set out in our Terms, you must not use our Website.

 

2.3. From time to time, we may update our Terms. Any change will be effective from the time they are published on our Website. Where a change is made, your continued use of our Website deems that you have accepted the updated Terms.

 

3. Intellectual Property

 

3.1. All content on our Website, including, but not limited to, all text, images, photographs, videos, colour combinations, layout, design, logos and computer code (together the “Content”) are owned by us and/or our licensors. All of the Content is subject to intellectual property rights, including, but not limited to copyright, trademark and patents.

 

3.2. Access to our Website does not entitle you, or any other individual or legal person, to any intellectual property rights.

 

3.3. Except as otherwise provided by these Terms, we do not give you permission to copy, distribute or use any of our Content for any purpose, except where you have first obtained our express written permission.

 

3.4. Despite clause 3.3, you may use or share our Content on the following conditions only:

  • your use or sharing of our Content is for non-commercial purposes only (this restriction does not apply to distributors of Passes or any institution which is running a special initiative in collaboration with us);
  • you do not amend or modify our Content in any way;
  • you expressly indicate the source of the Content is our Website.

 

4. Preparing and changing the Content

 

4.1. When preparing the Content, we have not taken your personal circumstances into account. It is ultimately your responsibility to consider our Content and decide whether it is suitable to your personal circumstances.

 

4.2. All Content (or any part thereof) may be changed by us at any time and without prior notification.

 

5. Website tools and features

 

5.1. All tools and features on our Website have been designed for information purposes only. Any result given by a tool or feature is based on the information or search parameters that you have entered. The given results are suggestions only. We do not guarantee that those suggestions are right for you. It is your responsibility to determine whether the suggestions are suitable to your personal circumstances.

 

5.2. We reserve the right to add, remove or modify any tool or feature on our Website at any time and without prior notice.

 

6. Your personal Eurail or Interrail account

 

6.1. To make optimum use of our Website, you may create a personal Eurail or Interrail account ("Account"). In your Account, you can manage your Pass(es) and Seat Reservation(s), including the request for a refund or exchange (subject to our Refund and Exchange Policy), and the details of your Account.

 

6.2. An account may be created through either the Website or the Rail Planner App. In either case, you may create your account by providing us with your name and email or by using your Facebook or Google account. Whichever method you choose, you must also consent to our Privacy and Cookie Statement.

 

6.3. After creating an Account, you must keep your login details strictly confidential. Unless you notify us that your Account has been compromised, all actions taken through your Account are your sole responsibility and at your own risk.

 

6.4. You must have an Account in order to purchase a Pass and Seat Reservation through our Website.

 

7. Purchasing and using Passes and Seat Reservations

 

7.1. If you purchase a Pass and/or Seat Reservation through our Website, there are additional terms and conditions that you must agree to. These are available for your review and consideration at all times on our Terms and Conditions webpage or via the footer of our Website.

 

7.2. Your use of a Pass and any Seat Reservation is subject to the Pass Conditions of Use and the conclusion of a Contract of Carriage. For more details on the Contract of Carriage, please see the Pass Conditions of Use.

 

8. The timetable

 

8.1. The timetable featured on our Website functions as a static timetable only. This means that it does not show any real-time scheduling data. Instead, the scheduling data shown in the timetable is drawn from a database which is updated four (4) times per week using data received from the participating railway carriers.

 

8.2. We do not change, amend or interfere with the scheduling data provided by the participating railway carriers in any way, except to the extent necessary to integrate the data into our Website.

 

8.3. As the scheduling data is provided to us by the participating railway carriers, we do not guarantee that the timetable is accurate. For the latest and most up-to-date scheduling data (including information on changes, delays and cancellations), you must check the website or mobile application of the relevant railway carrier or the departure and arrivals board at the station.

 

9. Pass Benefits and Travel Deals

 

9.1. We have partnered with a number of third parties to provide holders of a Eurail or Interrail Pass with the opportunity to access and use benefits which complement the Pass, ranging from discounts to free products and services (“Benefits”). These Benefits can be found via our Benefits Portal, which is separate to the Website. Your access and use of the Benefits Portal and of any Benefit is subject to the Benefits Portal Terms and Conditions.

 

9.2. In addition to the Benefits, our Website provides information about opportunities to book accommodation, purchase travel insurance and other various travel experiences (“Travel Opportunities”) which are available to both Pass holders and non-Pass holders. These Travel Opportunities are provided for information purposes and for your convenience only. When you take advantage of a Travel Opportunity, you do so under the terms and conditions of the provider or supplier of the same.

 

9.3. In both cases, when you book or arrange a Benefit or Travel Opportunity, you do so directly with the provider or supplier of the respective Benefit or Travel Opportunity. We are not a party to any contract between you and the provider or supplier nor do we have any responsibility or liability to perform any obligation under such a contract. Any payment that you must make in relation to a Benefit or Travel Opportunity must be paid directly to the relevant provider or supplier.

 

10. Customer Service

 

10.1. You may direct all of your questions, queries and complaints about our Website and any of the products or services sold through the Website to our Customer Service team. Our Customer Service team may be contacted using one of the methods found on our Help centre webpage.

 

10.2. When you are communicating with our Customer Service team, our Service Policy applies at all times.

 

11. Feedback

 

11.1. To help us improve our Website and the products and services that we offer, we always appreciate your feedback, both positive and constructive. We will use your feedback in an aggregated way to improve our Website and the products and services that we offer.

 

11.2. If you would like to give us feedback, you can do so via different methods on our Website. In some cases, there is a feedback button on your screen and other times a feedback pop-up will appear.

 

11.3. After you give us your feedback, we will not contact you. If you require a response, please contact our Customer Service team.

 

12. External websites

 

12.1. Our Website may contain links to or information about external websites operated by third-parties (“External Website(s)”). We have not investigated or analysed nor do we exercise any control or influence over these External Websites.

 

12.2. All links to or information about the External Websites shall not constitute or be construed as our endorsement.

 

12.3. If you access an External Website via our Website, you do so under the terms of use of that External Website and at your own risk.

 

13. Availability of our Website

 

13.1. We reserve the right to take the Website (or any part thereof) temporarily or permanently out of service for any reason and at any time. There may also be times where our Website (or any part thereof) is not accessible due to a technical fault or failure either in our systems or that of our suppliers. In either case (except where we decide to permanently take the Website out of service or any part thereof), we will work diligently to return the Website back to service as soon as possible.

 

14. Testing of our Website

 

14.1. From time to time, we conduct testing on the visuals, copy, descriptions, functionality, product offering, product conditions and product pricing on our Website. Testing will only be conducted on users who have consented to use of statistics and/or marketing cookies.

 

14.2. During our testing (if you are a participant), you may see a different version of our Website than the one which is shown to users who did not consent. Testing shown is not personalised and does not use personal data. The differences may include, but are not limited to, differences in the visuals, copy, descriptions, functionality, available products and services and the conditions and prices of products.

 

14.3. If you wish to participate in our testing, please ensure that you have allowed statistics and/or marketing cookies. If you change your mind, or do not wish to participate, please ensure that your statistics and marketing cookies are disabled. You can do this using the Cookie Banner on our Website.

 

15. Privacy and cookies

 

15.1. Any and all personal data that we collect and process when you interact with our Website will be handled in accordance with our Privacy and Cookie Statement.

 

15.2. You can find the list of cookies, including the type, purpose, duration etc. that we collect on our Website using our Cookie Banner.

 

16. Restrictions on using our Website

 

16.1. You must not:

  • take any action that imposes or may impose (as determined by our sole discretion) an unreasonable or disproportionately large load on our (or our third-party providers') infrastructure;
  • interfere or attempt to interfere with the proper working of the Website;
  • bypass, circumvent or attempt to bypass or circumvent any measures we may use to prevent or restrict access to the Website or any other computer system or network connected to the Website;
  • run any form of auto-responder or ‘spam’ on the Website;
  • use manual or automated software, devices or other processes to ‘crawl’ or ‘spider’ any page of the Website;
  • harvest or scrape any Content, feature or tool from the Website;
  • take any action which interferes with the Website Purpose; or
  • otherwise take any action in breach of these Terms or any other guideline or policy that we impose.

 

17. Our liability

 

17.1. To the extent permitted by law, in no event will we, nor any of our members, directors, employees or advisors accept any responsibility or liability for any loss or damage arising out of or in connection to the following:

  • the Content, including any inaccuracies, obvious mistakes or incomplete or incorrect information;
  • any obvious mistake in the price and/or conditions related to the use and/or validity of a Pass and/or Seat Reservation;
  • any tool or feature of our Website;
  • any of the Benefits and/or Travel Opportunities;
  • your accessing and use of any External Website;
  • any time our Website (or any part thereof) is out of service;
  • any testing of our Website in which you are a participant.

 

18. Miscellaneous conditions

 

18.1. Violation of these Terms

  • If you violate any of these Terms, we reserve the right to block you from further access and use of our Website (or any part thereof).

18.2. Governing law

  • To the extent permitted by law, the interpretation of these Terms is to be governed and construed by the laws of the Netherlands.
  • In the event of a dispute, our Customer Service team will endeavour to reach a reasonable resolution with you. If a reasonable resolution cannot be reached, the competent court is the District Court of Central Netherlands.

18.3. Severability

  • If any of the terms set out in these Terms are found to be unenforceable or contrary to law or otherwise invalid, the remaining terms shall remain unaffected and enforceable.

18.4. Waiver

  • Our failure to enforce any part of these Terms shall not constitute a waiver of our right to enforce that or any other part of these Terms. In order for any waiver of compliance to these Terms, we must provide you with written notice of such waiver through one of our authorised representatives.

18.5. Prevailing of the English version

  • To the extent of any inconsistency between the English language version of our Website or these Terms and any other language version, the English language shall prevail.
